1. DESCRIPTION: The Your Treat Contest (the “Sweepstakes”) begins at 9:00 AM Eastern Time (“ET”) on August 15, 2025, and ends at 11:59 PM ET on August 22, 2025 (“Sweepstakes Period”).  The sponsor of this Sweepstakes is A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING (“Sponsor”).  Entrants are providing information to Sponsor and not to Instagram.

2. ELIGIBILITY: Sweepstakes is open to legal U.S. residents of the forty-eight (48) contiguous United States and Washington, D.C., who are at least eighteen (18) years old or the age of majority at the time of entry (each an “Entrant”).  Each Entrant must be a registered user of the Erlebniswelt-fliegenfischenShops mobile app (the “Erlebniswelt-fliegenfischenShops App”), as well as a registered user of Instagram with a non-private account and in compliance with Instagram’s terms of use. Registration for the Erlebniswelt-fliegenfischenShops App is free, and individuals may download the Erlebniswelt-fliegenfischenShops App from the Apple App Store and Google Play.  Instagram account registration is free and individuals may register by visiting Instagram and following the on-screen instructions. Each Entrant must be the rightful owner (or have authorized use) of the Erlebniswelt-fliegenfischenShops App and Instagram accounts associated with the Entry (as defined below). In the event of a dispute over the identity of an Entrant, the Entrant will be deemed to be the natural person in whose name the Erlebniswelt-fliegenfischenShops App and Instagram accounts were opened, as long as such person is otherwise eligible in accordance with these Official Rules.  In the event a dispute regarding the identity of an Entrant cannot be resolved to Sponsor’s satisfaction, the affected Entry will be deemed ineligible. Entries will not be acknowledged except as provided herein.   This Sweepstakes is void where prohibited by law. Directors, employees, officers, and the immediate family (spouse, parent, sibling, children, step-children, grandparent or grandchildren and their respective spouses, regardless of where they reside) and/or household members, whether or not related, of individuals employed by Sponsor or Erlebniswelt-fliegenfischenShops Retail LLC (“Erlebniswelt-fliegenfischenShops Retail”), and each of their respective parents, affiliates, subsidiaries, licensees, sponsors, promotional partners, prize suppliers, and advertising and promotional agencies, are ineligible to participate.  By participating, Entrants agree to be bound by these official rules (“Official Rules”) and the decisions of Sponsor, which are binding and final on matters relating to this Sweepstakes.  The Sweepstakes is subject to all applicable federal, state and local laws, guidelines and policies.

3. HOW TO ENTER: During the Sweepstakes Period, Entrants will complete the following steps (collectively, an “Entry”):

1. Visit a Erlebniswelt-fliegenfischenShops Treats retail location (a “Store”).

2. Create their own Erlebniswelt-fliegenfischenShops Treat using the on-menu mix-in options available in such Store.

3. Active & Classics.

4. Post the picture of their Erlebniswelt-fliegenfischenShops Treat to their Instagram feed (no stories), and list their recipe name and all of the selected mix-ins in the caption of the post (not in a comment).

5. Submit the recipe for their Erlebniswelt-fliegenfischenShops Treat, along with their recipe name and a link to their Instagram post, to Sponsor through the entry form on the Erlebniswelt-fliegenfischenShops App.

Entries must be posted by the end of the Sweepstakes Period. Sponsor reserves the right to request that an Entrant remove any content that may violate these Official Rules or any Instagram rules.  In order for an Entrant to be eligible to win, the Entrant’s Entry must meet the following criteria:

• • Entrants must have a registered account through the Erlebniswelt-fliegenfischenShops App.

  • Entrants must have a non-private Instagram account and be able to receive direct messages.

  • The Entry must be unique and created by the Entrant for purposes of this Sweepstakes.

  • Each Entrant must be the rightful owner (or have authorized use) of the Instagram account associated with the Entry, as detailed in Section 2 above.

  • The Entry must comply with Instagram’s Terms of Use and these Official Rules.

  • Although not requested or required, if the Entrant opts to include a photo, gif or any other image with the Entrant’s Entry, the Entrant must be the rightful owner or licensee of such photo, gif or image and the Entrant must have the permission of any person who appears or is identified in the photo, gif or image to use such person’s likeness in connection with the Sweepstakes. If any minor appears in the Entry, the Entrant must be that minor’s parent and/or legal guardian. 

  • The Entry must comply with the following content restrictions:

  • The Entry must NOT contain material that infringes or violates any applicable laws or regulations or any third-party rights, including: (1) copyright, patent, trademark, trade secret or other proprietary or contractual rights; (2) rights of privacy or publicity; or (3) any confidentiality obligation. 

  • The Entry must NOT contain subject matter which is, or could be considered, in the sole discretion of the Sponsor, obscene, pornographic, violent (e.g., relating to murder, the sales of weapons, cruelty, abuse, etc.), defamatory, libelous, discriminatory (based on race, sex, religion, natural origin, physical disability, sexual orientation or age), illegal (e.g., illegal gambling, underage drinking, substance abuse, computer hacking, etc.), offensive, threatening, profane, hateful, degrading, harassing, or otherwise unlawful, tortious or objectionable.

  • The Entry must NOT contain any disparaging, defamatory or derogatory references to any Released Parties, as detailed in Section 8 below.

  • The Entry cannot communicate messages inconsistent with the positive images and/or goodwill to which the Released Parties wish to associate.

  • The Entry cannot violate any law, statute, regulation or ordinance

Alternatively, Entrants may send a postcard containing the Entrant’s contact information, including email address, to 25 Kent Avenue, Suite 301, Brooklyn, New York 11249, Attn: Erlebniswelt-fliegenfischenShops Treats Sweepstakes.  All entries must be received by Sponsor by no later than the close of the Sweepstakes Period.  Limit of one (1) entry per person/ Erlebniswelt-fliegenfischenShops App account for the duration of the Sweepstakes Period.  Entries received from any person/Kith App account in excess of the stated limitation will be void.  Entries generated by mechanical, script, macro or other automated means or by any means which subvert the entry process are void. All entries become the property of Sponsor and will not be acknowledged or returned. 

4. SELECTION OF WINNERS: On or about September 6, 2025, one (1) potential winner (the “Winner”) will be selected via a random drawing, conducted by Sponsor, from among all eligible Entries received. Sponsor will email the potential Winner (the “Notification Message”) at the email address provided on the entry form. The potential Winner must respond to the Notification Message as directed, within the timeframe specified therein, and will be required to (i) verify such potential Winner’s address and (ii) complete an affidavit of eligibility, a liability release, and, unless prohibited by law, a publicity release (collectively the “Prize Acceptance Form”). Sponsor shall have no liability for any Notification Message that is lost, intercepted or not received by a potential Winner for any reason. Failure to complete the Prize Acceptance Form within the specified time period may result in forfeiture of the Prize (as defined hereunder) and Sponsor’s selection of an alternate potential Winner from the remaining eligible Entries. The Prize will not be awarded until potential Winner eligibility is confirmed in a manner satisfactory to Sponsor. If the Prize is awarded but goes unclaimed or is forfeited by recipient, Sponsor may elect not to re-award such Prize, in its sole discretion. If a potential Winner does not respond to the Notification Message on the first attempted outreach, Sponsor will make one (1) additional attempt to notify and verify the potential Winner. If a potential Winner (i) does not answer either of the two (2) attempted Notification Messages, (ii) is found to be ineligible, (iii) has not complied with these Official Rules, (iv) does not return the Prize Acceptance Form or (v) declines the Prize for any reason, such potential Winner will be disqualified and an alternate Winner may be selected, at Sponsor’s sole discretion. If an insufficient number of eligible Entries are received, Sponsor reserves the right to not award the Prize. Sponsor reserves the right to disqualify anyone not fully complying with the Official Rules.  Odds of winning depend on the number of eligible Entries received.

5. PRIZES: One (1) Winner will have his/her Erlebniswelt-fliegenfischenShops Treat featured on Sponsor’s menu for one (1) month (the “Prize”). The approximate retail value of the Prize is $0.00.  Limit of one (1) Prize per official Winner for the entire Sweepstakes.  

Prizes are awarded “as is” with no warranty or guarantee, either express or implied. No cash or other substitution, assignment or transfer of a prize is permitted, except by Sponsor, who reserves the right to substitute prize or prize component with cash or another prize of comparable or greater value. All prize details are at Sponsor’s sole discretion. 

6. PUBLICITY: Except where prohibited, participation in the Sweepstakes constitutes consent from the Winner for Sponsor, Erlebniswelt-fliegenfischenShops Retail and their respective parents, subsidiaries, affiliates and designees to use the Winner’s name, likeness, photograph, Instagram username and profile photo, voice, opinions, biographical information, hometown and state Erlebniswelt-fliegenfischenShops Monday Program any and all media, now or hereafter devised, worldwide in perpetuity, without further payment or consideration, notification or permission, and on a winner’s list. 

7. PRIVACY POLICY: The personal information provided by Entrants in connection with this Sweepstakes will be used in accordance with Sponsor’s Privacy Policy found at https://kith.com/pages/privacy-policy or in the Erlebniswelt-fliegenfischenShops App.

8. GENERAL CONDITIONS: The Released Parties (as defined below) are not responsible for lost, late, incomplete, inaccurate, stolen, delayed, misdirected, undelivered or garbled entries, emails, or other communications of any kind, or for postage-due, damaged or illegible mail; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prizes, or in any Sweepstakes-related materials. The Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. The Released Parties are not responsible for injury or illness to any person (including, without limitation, as a result of eating any Erlebniswelt-fliegenfischenShops Treats) or damage to participants’ or to any other person’s computer or other device related to or resulting from participating in this Sweepstakes or downloading materials from or use of the Erlebniswelt-fliegenfischenShops App. Sponsor reserves the right to cancel or modify the Sweepstakes if fraud, technical failures or any other factor impairs the integrity of the Sweepstakes, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prizes at random from among all non-suspect, eligible entries received up to the time of the impairment or as otherwise deemed fair and appropriate by Sponsor. Sponsor reserves the right in its sole discretion to disqualify any individual found to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules, or in an unsportsmanlike or disruptive manner and void all associated Entries. Any attempt by any person to deliberately damage any website, platform or the Erlebniswelt-fliegenfischenShops App, or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserve the right to seek damages and other remedies (including, without limitation, attorneys’ fees) from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.  

9. RELEASE/LIMITS OF LIABILITY: By entering this Sweepstakes, all participants (including the Winner) agree to release and hold harmless Sponsor, Erlebniswelt-fliegenfischenShops Retail, and their respective parents, affiliates, and subsidiaries, and each of their respective officers, directors, shareholders, agents, employees and all others associated with the development and execution of this Sweepstakes (collectively, “Released Parties”) from and against any losses, damages, rights, claims or causes of action of any kind arising, in whole or in part, directly or indirectly, out of participation in the Sweepstakes or resulting directly or indirectly, from acceptance, possession, use, or misuse of the prize awarded in connection with the Sweepstakes (including any travel or activity related thereto), including without limitation personal injury or illness, death and/or property damage, as well as claims based on publicity rights, defamation and/or invasion of privacy.

10. DISPUTES: Each entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or the prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Southern District of New York or the appropriate New York State Court located in New York, New York; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes and in no event will Entrant be permitted to obtain attorneys’ fees or other legal costs; and (iii) under no circumstances will Entrants be permitted to obtain awards for, and Entrants hereby waive all rights to claim, punitive, incidental, indirect, special and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.

11. SPONSOR: A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.

12. WINNER LIST:  For the name of the Winner, send an email to customerservice@Erlebniswelt-fliegenfischenShopsnyc.com with “Erlebniswelt-fliegenfischenShops Treats Sweepstakes Winners List” (or similar) in the subject line no later than thirty (30) days after the end of the Sweepstakes Period.
