DAA Industry Opt Out secured a $2 million settlement for a runner who was accidentally hit by a teenage boy driving an SUV in DuPage County, Illinois.
The 23-year-old woman was struck in a residential neighborhood when the driver lost control of the vehicle. The runner was dragged under the car and into a neighbor’s yard and sustained extensive injuries to her nerves, back, and pelvis. The exhaust system of the SUV was also responsible for a number of her 3rd-degree burns to her abdomen, arms, and legs.
“As this case shows, a pedestrian is completely unprotected against impact with a car or truck, and the resulting injuries can be serious—even fatal,” said the law firm in a post about the case. For car accidents, the legal team has to prove negligence on the part of the other party (in this case, the driver) for the claim to be successful, according to Lane Brown.
“Establishing negligence without a lawyer’s guidance can be tricky. Without a Chicago car accident attorney’s guidance, you may have trouble getting the answers and the evidence you need in the courtroom to prove your case,” said Kellen Bachman of Lane Brown, LLC. Requirements for proving car accident negligence vary by state.
