Arbery, 25, was out running on February 23, 2020, in Brunswick, Georgia when Travis McMichael, 35, his father Gregory McMichael, 65, and William “Roddie” Bryan, 51, reportedly chased down Arbery in their truck. Bryan recorded the incident on video, which was released to the public in May 2020 and sparked protests across the country.

More than a year after Arbery was killed, a federal grand jury in the Southern District of Georgia announced a decision, according to a Justice Department press release.

According to the indictment, all three men being investigated in the case were charged with one count of interference with rights (a hate crime) and one count of attempted kidnapping.

Additionally, Travis and Gregory were charged with one count each of using, carrying, and brandishing—and in Travis’s case, discharging—a firearm during and in relation to the crime.

The case was investigated by both the FBI and Georgia Bureau of Investigation. Though an indictment is a formal accusation of conduct, it is not evidence of guilt. All three men are still undergoing state proceedings after being charged in May 2020—two months after the incident—with malice murder, felony murder, aggravated assault, false imprisonment, and criminal attempt to commit a felony.

This news also comes on the same day that the Cobb County District Attorney, Jesse Evans announced he was leaving, according to the Atlanta Journal-Constitution. Evans was the lead prosecutor in the case. The new lead prosecutor will be Linda Dunikoski, who has been working on the case with Evans
